Refund policy – The Coffee Miner

Refund policy

1. Right of withdrawal

In the case of distance contracts, the consumer has the right, under the Consumer Protection Act (ZVPot-1), to withdraw from the contract within 14 days without stating a reason. The withdrawal period begins on the day the consumer (or a third party designated by the consumer, other than the carrier) receives the goods.

To exercise the right of withdrawal, the consumer must notify us with an unequivocal statement (e.g. by email to mitjarc@gmail.com or by using the withdrawal form). The notice is considered timely if it is sent before the withdrawal period expires.

Exceptions to the right of withdrawal
The right of withdrawal does not apply to coffee and other goods supplied in sealed packaging that are not suitable for return for health or hygiene reasons, if the seal has been opened after delivery.

2. Return of goods

The consumer must return the goods without undue delay, and no later than 14 days after notifying us of the withdrawal, to the following address:

TheCoffeeMiner Ltd., Ulica OF 7, 8210 Trebnje, Slovenia

A copy of the invoice and all accompanying documents must be enclosed. The goods must be returned complete, in the same quantity and, where possible, in the original packaging. The direct cost of returning the goods is borne by the consumer. The consumer bears the risk of loss or damage to the goods during return shipment, unless it occurs through no fault of his own.

A distance purchase is not a trial purchase. The consumer may inspect and test the goods only to the extent necessary to establish their nature, characteristics and functioning, as would be possible in a shop.

Reduction of the refund due to loss of value
The refund may be reduced if the returned goods have lost value as a result of handling beyond what is necessary to establish their nature, characteristics and functioning. In particular, we may deduct:
– the cost of replacement packaging and repackaging, if the original packaging is damaged, written on or incomplete beyond what is necessary to open it;
– the cost of cleaning, repair or replacement of missing parts, if the goods (including devices) show signs of use, damage or are incomplete;
– a reduction corresponding to the loss of value, if the goods can no longer be sold as new.

The amount deducted will correspond to the actual costs or loss of value. We will inform the buyer of the amount and reason for any deduction before issuing the refund.

Free gifts
Free gifts are provided only in connection with the purchase. In the event of withdrawal from the contract, the gift must be returned together with the purchased goods, unopened and undamaged. If the gift is not returned or has been opened, its value (as stated in the offer) will be deducted from the refund.

Failure to collect the shipment
If the buyer fails to collect the shipment without having previously notified us of withdrawal from the contract, the buyer is obliged to reimburse the actual costs of delivery and return of the shipment. These costs will be deducted from any refund or invoiced to the buyer.

3. Refund of payments

In the event of withdrawal, we will refund all payments received, including the cost of standard delivery, without undue delay and no later than 14 days after receiving the notice of withdrawal. Additional costs resulting from the buyer's choice of a delivery method other than the cheapest standard delivery we offer are not refunded.

We may withhold the refund until we have received the returned goods or until the buyer has provided proof of having sent them back, whichever is earlier.

The refund will be made using the same means of payment as used by the consumer, unless the consumer has explicitly agreed to another means of payment and does not incur any costs as a result.

4. Exchange of goods

If the consumer wishes to exchange the goods, they must be returned to TheCoffeeMiner Ltd., Ulica OF 7, 8210 Trebnje, Slovenia. After receiving the returned goods, we will refund the purchase price in accordance with the above provisions. The consumer may then place a new order for the desired goods.

5. Lack of conformity of goods (material defects)

The seller is liable for any lack of conformity of the goods that exists at the time of delivery and becomes apparent within two years of delivery. For used goods, a shorter period may be agreed, but not less than one year.

The consumer must notify the seller of the lack of conformity within two months of discovering it. The notification must describe the defect in detail, and the consumer must allow the seller to inspect the goods.

The consumer may request that conformity be restored free of charge by repair or replacement of the goods. If this is not possible or is not carried out within the statutory period, the consumer may request a proportionate price reduction or a refund of the purchase price, in accordance with the Consumer Protection Act.

If the lack of conformity is not disputed, the seller will comply with the consumer's request as soon as possible and no later than within eight days. If the lack of conformity is disputed, the seller will give the consumer a written reply within the same period.

6. Consumer rights

All other rights of the consumer are governed by the provisions of the Consumer Protection Act (ZVPot-1).

7. When the goods are not in stock

We must fulfil the order within 14 days of concluding the contract, unless otherwise agreed with the customer. If the ordered goods are not available and we are unable to fulfil the order, we will inform the customer immediately and refund all payments made without undue delay, and no later than 14 days.
